R v. Simon was a landmark case in which the Supreme Court of Canada affirmed that the Mi’kmaq had a continuing treaty right to hunt for food under the 1752 Treaty. It established that historical treaties must be interpreted liberally and in favour of Indigenous peoples, strengthening the legal recognition of Mi’kmaq treaty rights.
